The discussion opinions of the Lao Cai National Assembly Delegation were recognized and appreciated by the National Assembly
On the morning of October 26, at the 4th session, the 15th National Assembly, after working sessions at the Hall, the provincial National Assembly delegation had a second session to participate in discussions at the National Assembly.Comrade Dang Xuan Phong, Member of the Party Central Committee, Secretary of the Provincial Party Committee, Head of the Provincial National Assembly Delegation, Head of the 10th Discussion Group, presided over the discussion in the group comprised of provincial National Assembly delegations from Lao Cai, Vinh Phuc, Dak Lak, and Hau Giang.
Comrade Bui Thi Minh Hoai, Secretary of the Party Central Committee and Head of the Central Committee for Mass Mobilization, was present at the Discussion Group No. 10 session.
Comrade Dang Xuan Phong chaired the discussion at Discussion Group No. 10 on the morning of October 26.
The discussion session focused on two topics: comments on the draft Resolution on piloting the right to choose license plate use through auctions, and the draft Resolution on piloting a number of specific mechanisms and policies for the development of Buon Ma Thuot City, Dak Lak Province.
The Leader of Discussion Group No. 10, Head of the Lao Cai Provincial National Assembly Delegation Dang Xuan Phong, suggested at the start of the discussion session that the delegates focus on discussing and giving opinions on the necessity of promulgation and the name, layout of the pilot resolution granting the right to choose to use license plates of automobiles through auction; comment on the starting price; deposit amount; auction order and procedures; cases such as there is an auction participant, a bidder; obligations and interests of the auction winner, the recipient of the transfer, gift or inheritance of the number plate...
Comrade Dang Xuan Phong, Head of Discussion Group No. 10, also proposed piloting a number of specific mechanisms and policies for the development of Buon Ma Thuot city, Dak Lak province, with delegates from four provinces focusing on the necessity of enacting the Resolution; on financial management of the state budget, tax incentives, planning policies, and incentives for talented experts and scientists who want to work in Buon Ma Thuot, Dak Lak province.
Mr. Sung A Lenh, Deputy Head of the Provincial National Assembly Delegation Lao Cai, said during a discussion session at the group on the morning of October 26 for the pilot resolution granting the right to choose the use of license plates through auctions: "The issuance of a resolution is very necessary because in the past time, many localities have auctioned license plates, which are highly appreciated by the people, organizations, and individuals and bring economic and social efficiencies. However, due to a lack of a legal framework and issues with mechanisms and policies, implementation was fraught with difficulties.
Delegate Sung A Lenh cites the fact that many individuals and organizations have the need to own number plates according to their preferences, often called "beautiful number plates" and are willing to pay large costs to own such number plates.
Giving the right to use "beautiful number plates" through auction is a "double benefit," because it both meets needs and creates social justice, while also improving vehicle management efficiency; increase revenue for the state budget; avoid the ask-for-give mechanism and lack of transparency in license plate issuance;
Delegates of the Provincial National Assembly focus on reviewing draft resolutions and law projects before giving opinions.
Participating in the specific contents of the draft resolution, Delegate Sung A Lenh stated that, as stated in Clause 1, Article 5 of the draft Resolution on the starting price, the determination of the starting price of vehicle license plate is unregulated and difficult to enforce. As a result, when auction participants are from all over the country, regulating different starting prices between zones 1 (40 million Vietnamese dong) and 2 (20 million Vietnamese dong) makes no sense. Delegates proposed that there be no regional limitations or discrimination, and that a nationwide starting price of 40 million Vietnamese dong be applied uniformly.
Article 5 of the draft Resolution states in Clause 3: "The Government shall specify the management and use of auction proceeds." Concerning this content, delegate Sung A Lenh stated that it is inappropriate and proposed changing it to: "The money collected from the auction of vehicle license plates must be remitted to the state budget in accordance with the provisions of the Budget Law." This ensures strictness, transparency, and public awareness.
* On the afternoon of October 24, Comrade Dang Xuan Phong, member of the Party Central Committee, Secretary of the Provincial Party Committee, and Head of the Provincial National Assembly Delegation presided over the discussion of the previous discussion group No. 10 opinions on the draft Resolution promulgating the National Assembly's Regulations (amended), the draft Anti-Money Laundering Law (amended), and the draft National Assembly Resolution on the statute of limitations for disciplinary actions against officials and civil servants.
The National Assembly should certainly recognize and appreciate the opinions of the Leader of the 10th Discussion Group and the Lao Cai Provincial National Assembly Delegation, which were carefully prepared, researched, and argued.
Comrade Dang Xuan Phong suggested during the 10th discussion group session on the above contents that when studying, reviewing, and giving opinions on the draft Law on prevention and combat of money laundering, it should be compared with the regulations other agreements and international treaties to which Vietnam has acceded.
Comrade Dang Xuan Phong chaired the discussion at Discussion Group No. 10 on the afternoon of October 24.
Regarding the draft National Assembly resolution on the statute of limitations for disciplinary action against cadres, civil servants, and public employees, the Secretary of the Provincial Party Committee and the Head of the Lao Cai province National Assembly Delegation suggested that the discussion following Conclusion No. 69 of the Government, dated 6/7/2022, contains regulations for dealing with and disciplining cadres, party members, and Party organizations. Some government regulations on the statute of limitations for handling and disciplining cadres, civil servants, and public employees, as well as the Civil Servant and Public Employees Act.
Mr. Sung A Lenh, Deputy Head of the Lao Cai Provincial National Assembly Delegation, proposed reconsidering the subject of application as business individuals in a direct comment on the draft Law on Prevention and Combat of Money Laundering (amended) in Clause 2, Article 2 of the draft law on organizations and individuals conducting non-financial transactions.
The reason for this is that, when compared to a number of articles and clauses specified in the Commercial Law, the Civil Code, the Government's Decree 39/2007/ND-CP on commercial activities, and the Decree No. 01/2021/ND-CP Government's on business registration, the provisions in Clause 2, Article 2 of the draft Law on Anti-Money Laundering are inconsistent with other laws and sub-law documents, making implementation difficult.
